Just wanted to let you know I posted another song. The first one has gotten more plays than I ever dreamed. EZ Folk radio is the best! Anyway, this one is not Clawhammer Banjo--the banjo part is more strum style, but it is still a great song. I am pretty sure it is a Jimmy Dean song. It is called I wont Go Hunting With You Jake (But I'll go Chasing Women). Any info is appreciated. Andrew Lentini (playthebanjo)

Thanks! I am really glad that you liked it. And yes, It was the last track after about 10 hours in a studio in Seattle. No stores around except the beer store, so we were all pretty hammered by the time we got around to recording it. But it came out GREAT.

Thanks again! Andrew

Andrew -

Just a thought - have you made sure that this is a public domain song? I know I have heard it on "Hee Haw", and on radio by a couple of different singers back between the 60's and now, but I believe that it may be under copyright (fairly positive, if it is a JD song).

I hate to be the cold water thrower, but we need to keep Richard safe for all of our sakes. :shoot:

honestly i don't know. we got the music from the internet and there was no copyright listed on it. (i know that doesn't mean anything). i searched google for it again and found the sheet music at another source that said "sheet music from the digital folk archive" or something like that...again no copyright. i searched the jimmy dean websites i could find but didn't come up with anything. anybody know anything more? maybe if richard is moderating he can decide if he wants me to take it down? i know that the copyright will last (unless renewed) for 70 years past the death of the author. so if it was copyrighted, it probably still is. but wouldn't the sheet music be copyrighted as well? i am not being argumentative....i am just curious. i will gladly take it down. or if anybody knows where i can email to ask for the right to post it, that would be great too!

Andrew...

I love the song and the way you guys recorded it, but it is under copyright so it will have to be deleted.

It was written in 1949 by the great songwriter Stuart Hamblen, who wrote classics like "This Old House" and "It is No Secret (What God Can Do)." Here's a link to a page that mentions this song...

http://www.nashvillesongwritersfoundation.com/fame/hamblen.html

Anyway, I for one hate to see this one go but we need to stick with the program. I hope you'll be working on some more songs you can post on ezFolk. Your recording of "Cluck Old Hen" has been one of the most popular songs on ezFolk and I was hoping you'd post more. Thanks for understanding.

Andrew-

I didn't mean to be a blue meanie, I also enjoyed your rendition of it while it was here. I am glad that Richard found the copyright info for you.

As a performer, you might want to check out the Harold Fox agency regarding buying performace rights - Richard knows something about that, there was a discussion in his original "copyrighted stuff" post about licenses, if I remember correctly.

Looking forward to more of your stuff - being a cla-whammerer myself.

The song was written by Stuart Hamblin.  It was a song I personally heard him say he wished he had never wrote.  After the song went out of copywrite other artists began recording it.

So does that mean that I can repost the version of it?

Well, actually, if it was written in 1949, it isn't out of copyright. Other artists have, and probably will, continue to "cover" it, but they will also pay royalties to the copyright holders.

I would think that you could repost it.  I think Stuart Hamblin died in 1989, but don't know if Suzie is still alive or not.  If Stuart Hamblin had any children I never heard anything about them.  Another writer said the song was copyrighted in 1949, but I don't know how long the original copyright lasted or if it could have been renewed or not.  I do know that my moms dad wrote and copyrighted a song in the 1920's, and the song was recorded by someone, but grandpa or his family never received any royalty's from it.  It has been recorded by at least 2 others since then as well, and no royalties were ever paid. (Although one of the groups that I downloaded from the net did send me their cd when I let them know the history of the song.  I wasn't after any royalties, I was just proud some people found the song and recorded it.).
