Thanks for the link UJ... Great resource! That book costs $100 on Alibris.

I wonder about the copyright implications on scanning a book like that and posting it on the Internet. Although it's out of print it's fairly recent -- published by Oak Publications in the 1970s. I've got dozens of fairly recent out-of-print books of the same sort that I'd scan and post on ezFolk if I thought it was okay. My understanding is that anything newer than 1923 can't be reproduced without the written consent of the copyright holder.

Whaddya think?

first, if somebody is making a c note in the second hand market, whose interest is served by protecting the info?

i think that in folk music there are a lot of folks claiming copyright that might not be valid. in this case, and in many others but not necessarily all, scholarly interest trumps any claim to ownership made by a compiler.

that's my opinion as a musical outlaw, though.

i say "post away!" what's the worst that can happen? somebody issues a cease and desist letter on this or that title? so then you delete. :bluelight:

Thanks for the link, Uke. I've got all of the songs on Folkways recordings, but I've been too lazy to sit and copy all of the lyrics. I'll be able to cover '"Down on Penny's Farm" next week. I've been wanting to do that song for years.

And they had Furry Lewis' "Kassie Jones"... one of my all-time favorites.

Hmm. I thought that if a book was out of print that copies could be legally made for not-for-profit or educational purposes. It seems that way with sheet music, or maybe I'm just aware of some handy rationalizations.

There is a handy online form to click through to help one decide whether a use is fair.

Based on the four factors test, re-publishing an entire work (out of print or not) on the web without permission appears not to be fair use.

I'm not a lawyer.  Fair use is complicated. I deal with copyright issues a lot and tend to err on the side of caution. In my non-lawyerly opinion, unless a work is pre-1923, permission has to be sought to copy entire works and/or publish them on the web, in or out of print.

A bit more:  There is a personal fair use discussed here: http://www.usg.edu/legal/copyright/#part3d3b .

http://www.menc.org/information/copyright/copyr.html#reproducing has details for the school setting (which has more flexibility than non-school uses).

It also has, in Appendix E, a form for requesting permission to copy (not necessarily to publish on the web) a work that is out of print.


Anyone else's head hurt thinking about this?

Greetings Malcolm and all,

Thanks for posting the link.

If interested I have the song index, by title and first line, in a document format for the book “Irish Emigrant Ballads and Songs”. This is a book published in 1975 by Bowling Green Press. The song lyrics, score when available, and discussions were compiled by Robert Wright. It documents the lyrics to a few hundred songs that were sung by the Irish immigrants here in America.

I am willing to share this with anyone interested. Just email me. If you are seeking the lyrics to any of the songs documented in the book let me know. The index was posted on Mudcat.

As to the copyright issues I have no idea.

My head and my stomach start to hurt when I start thinking about copyright.

Lately, I've been working off a general rule: if it's an old song, and I find that more than a few folks have copyrighted it, I assume that means only the arrangement is copyighted. Granted that's not entirely correct thinking, but as an example, if I plug "Death Don't Have No Mercy" into the U.S. Copyright Office web site, I get copyright notices for a lot of folks, but nothing comes up with the name of the guy who is often credited (incorrectly) for writing the song in 1962... Reverend Gary Davis.

It sometimes takes awhile to find what I'm looking for -- titles sometimes don't come up under what I thought -- but, for example, searching for copyright notices of "'Tain't nobody's business if I do," so many folks of so many different genres have copyrighted the song, with Bessie Smith's version (the one I take to be the original from the 1920's) not being copyrighted until 1982, that I'm thinking it's free and clear for me to record and post on the Internet.

(I'm just an old hack from Humboldt... can't afford an attorney... so I expect someday some ASCAP, BMI or Harry Fox sharpshootin' lawyer will sue me for all the dirt I walk on.)
